How filing bankruptcy affects copyright ownership (and whether a trustee takes IP)
When you file bankruptcy, your copyright ownership is evaluated as property under bankruptcy law, meaning it may become part of the “bankruptcy estate.” In a typical individual Chapter 7 bankruptcy, a trustee is appointed to identify non-exempt assets that can be sold to pay creditors, and intellectual property rights can be included in that review. That does not mean the trustee automatically “takes” your copyrights; it means the trustee can evaluate whether the copyrights have value that should be administered for the benefit of creditors. If the copyrights are low value, difficult to monetize, properly exempted, or burdensome to administer, the trustee may abandon them, allowing you to retain them.
